By creating an account or using Kopik, you accept these terms.
This English version is provided for convenience. The French version is the legally binding one and prevails in case of any discrepancy. Read the French version
1. Purpose
These terms of use govern access to and use of Kopik (the “Service”), published by DOM ENGINEERING, SAS with a share capital of €200, registered with the Vienne trade register under number 999 391 675, whose registered office is at 26 rue du Tissage, 38230 Tignieu-Jameyzieu, France (the “Publisher”).
Kopik is a marketplace for knowledge bases. Creators upload documents, from which the Service automatically builds a searchable knowledge base (retrieval-augmented generation, or RAG). Buyers ask questions to these bases, from the website, the REST API or the MCP server. For each Question, the Service retrieves the most relevant passages of the knowledge base, and a language model writes an answer based solely on those passages, citing the passages it relies on. Where the knowledge base does not contain the answer, the answer says so.
Paid features (chat subscription, prepaid credit, per-request billing via the API and MCP, creator remuneration) are also governed by the Terms of Sale.
2. Definitions
- User: any person using the Service, with or without an account.
- Creator: a User who creates a knowledge base and uploads documents to it.
- Buyer: a User who asks questions to a knowledge base.
- Knowledge base: a set of documents uploaded by a Creator, indexed by the Service, with its own page.
- Question: a request sent to a knowledge base, from the website, the API or MCP.
- Credit: the prepaid balance, in euros, used to pay for Questions.
3. Account
Creating a knowledge base or asking questions requires an account. You must be of legal age and have the legal capacity to enter into a contract; if you act on behalf of a company, you warrant that you are authorised to bind it.
You agree to provide accurate information and to keep your login details confidential. Any action taken from your account is deemed to have been taken by you. Authentication is handled by our provider Clerk.
4. Creators: content and responsibility
Creators are solely responsible for the documents they upload and for the title, description and price of their knowledge bases. By uploading a document, the Creator warrants that:
- they own the document or hold all the rights required to upload it and have it queried and quoted by third parties, including for a fee;
- the document does not infringe any third-party right (copyright, trademarks, trade secrets, confidentiality obligations, image or privacy rights);
- the document does not contain personal data about third parties unless its publication is lawful, nor any sensitive data;
- the document is not unlawful, defamatory, hateful, violent, pornographic, misleading or otherwise contrary to law or public order.
The Creator indemnifies the Publisher against any claim, action or penalty brought by a third party in relation to the documents they uploaded, and bears the resulting costs.
5. Licence granted to Kopik
The Creator remains the owner of their documents. To operate the Service, the Creator grants the Publisher a non-exclusive, worldwide, royalty-free licence, for as long as the documents are online, to: store and reproduce the documents; extract their text, split it into passages and index it; send passages to the AI model provider that generates answers; and display or serve excerpts of the documents in answers to Buyers, on the website, through the API and through MCP.
Documents are used only to answer Questions asked to the knowledge base that contains them. The names of the documents are shown on the page of a public or unlisted knowledge base; their full content is never displayed, only the passages cited in answers.
The Creator also authorises the Publisher to display the title, description and topic of public knowledge bases in the catalogue and to use them to promote the Service.
This licence ends when the document or the knowledge base is deleted, subject to backup copies, which are erased within a reasonable time, and to answers already delivered.
6. Visibility and moderation
The Creator chooses the visibility of each knowledge base:
- public: listed in the catalogue and open to all Users;
- unlisted: not listed in the catalogue, reachable only by those who have its link, which contains a long random identifier;
- private: reserved to its owner, who can query it from the website, through the API and through MCP with their own API key.
The Publisher does not review documents before they are published, but may, without notice, hide, unlist or delete any content that breaches these terms, following a notice or on its own initiative, and suspend the account concerned.
Creators can see the text of the Questions asked to their knowledge bases, but not the identity of the Buyers who asked them. Do not include personal information in your Questions.
7. Asking questions
Asking Questions on the website requires an account. Every account with a verified email address gets 1 free Question per month on the website. It does not carry over to the next month and does not apply to the API or MCP. Beyond that, Questions on the website require a Subscription, and Questions via the API or MCP are charged at the price set by the Creator and debited from the Buyer's Credit, under the conditions of the Terms of Sale. A Question is neither charged nor counted when the knowledge base contains nothing relevant or when the answer fails for a technical reason.
A Creator's Questions to their own knowledge bases are free, within a fair-use limit of 200 Questions per day.
8. API keys and MCP
Users can create API keys to query knowledge bases through the REST API or the MCP server. A key is shown only once, when it is created; the Publisher stores it only in hashed form and cannot display it again. API keys are personal and secret: you are responsible for keeping them safe and for every Question made with them, which is charged to your Credit. Revoke a key immediately from your dashboard if you think it has leaked.
The Publisher may suspend any key used abusively.
9. Limits and fair use
To protect the Service and its Users, the following limits apply at the date of these terms:
- Questions: 20 per minute and 1,000 per day per User; a Creator's free Questions to their own knowledge bases: 200 per day;
- public endpoints accessible without an API key: 120 requests per minute per IP address;
- MCP: at most 10 requests per batch;
- knowledge bases: 20 per account;
- per knowledge base: 1,000 documents and 20 million characters in total;
- per document: 4 MB per file and 2 million characters;
- uploads: 120 per hour.
These limits may change with the Service. The Publisher may slow down, block or suspend any use that is abusive or likely to disrupt the Service, including within these limits.
10. Acceptable use
When using the Service, you agree not to:
- use it for an unlawful purpose or in breach of third-party rights;
- attempt to extract, copy or rebuild all or a substantial part of a knowledge base, in particular through automated or systematic questions;
- circumvent billing, the free-question limit (for example by creating multiple accounts) or the technical protections of the Service;
- attempt to manipulate the answer engine, access other users' data, or disrupt the Service (attacks, excessive load, malicious code);
- resell or redistribute access to the Service or answers at scale without the Publisher's written agreement.
11. AI-generated answers
Answers are generated automatically by a language model, solely from the passages retrieved from the knowledge base, and cite those passages. They may nonetheless be inaccurate, incomplete or outdated, and they are only as reliable as the documents provided by the Creator, whose accuracy the Publisher does not check.
Answers are provided for information only and do not constitute professional advice (legal, tax, medical, financial or other). Check the sources cited and, for any important decision, consult a qualified professional.
12. Personal data
DOM ENGINEERING is the data controller for the personal data processed through the Service, in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.
- Data processed: account data (email address, name, login data), questions asked and answers, usage and billing history, Credit and earnings, API keys (stored in hashed form), uploaded documents and technical logs.
- Purposes and legal bases: providing the Service and billing (performance of the contract); security, fraud prevention and improvement of the Service (legitimate interest); accounting and tax obligations (legal obligation).
- Documents: the documents uploaded to a knowledge base are used only to answer the Questions asked to that knowledge base.
- Questions and Creators: the text of the Questions asked to a knowledge base is visible to its Creator, without the identity of the person who asked them. Do not include personal information in your Questions.
- Processors: Vercel (hosting), Railway (database), Clerk (authentication), Stripe (payment), an AI model provider (generation of answers). Some are located outside the European Union; transfers are governed by the European Commission's standard contractual clauses or an adequacy decision.
- Retention: for as long as the account is active, then deleted, except for data we must keep for legal reasons (accounting records: 10 years). The text of Questions and answers is erased 12 months after the Question was asked; only the billing record (amount, knowledge base, date) is kept.
- Your rights: access, rectification, erasure, restriction, objection and portability, by writing to hello@kopik.fr. You may also lodge a complaint with the CNIL (cnil.fr).
Kopik uses only the cookies needed for the Service to work (authentication, language preference). No advertising cookies are used.
13. Availability and changes
The Publisher uses reasonable efforts to keep the Service available but does not guarantee uninterrupted operation. The Service may change, in particular its features, formats accepted and limits.
14. Liability
The Publisher is bound by an obligation of means. It is not liable for the content of knowledge bases, for the use made of answers, or for indirect damages. Where its liability is established, it is limited to the amounts paid by the User to the Publisher over the twelve months preceding the event, except in case of gross negligence or wilful misconduct, and without prejudice to consumers' mandatory rights.
15. Termination
You can stop using the Service and request the deletion of your account at any time by writing to hello@kopik.fr. Unused Credit and earnings are handled as provided in the Terms of Sale. The Publisher may suspend or close an account that seriously breaches these terms.
16. Changes to these terms
The Publisher may update these terms. Users will be informed of any material change; continuing to use the Service after the change means accepting the new terms.
17. Governing law and disputes
These terms are governed by French law. In the event of a dispute, the parties will first seek an amicable solution by writing to hello@kopik.fr. Consumers may use a consumer mediator free of charge. Failing agreement, the competent French courts have jurisdiction, subject to the mandatory rules protecting consumers.
