Authorised CBAM declarant status: who must apply and how

Who applies

An importer established in a Member State applies for the status before importing CBAM goods, via the CBAM registry. Where the importer is not established in a Member State, the indirect customs representative must obtain the status, whether or not the importer falls under the de minimis exemption.

An indirect customs representative appointed by an importer can also agree to act as authorised CBAM declarant. It then takes on the importer's obligations for the goods it imports on that importer's behalf.

The status is granted by the competent authority of the Member State where the applicant is established and is recognised in all Member States.

Criteria and guarantee

The applicant must not have been involved in a serious infringement or repeated infringements of customs legislation, taxation rules, market abuse rules or the CBAM rules, and must have no record of serious criminal offences linked to its economic activity in the five years before applying. It must demonstrate financial and operational capacity, be established in the Member State of application and hold an EORI number.

A guarantee is required if the applicant was not established throughout the two financial years preceding the year of application. If the criteria are not met, the authority refuses the status with reasons and information on the right to appeal.

Processing deadlines

Under Implementing Regulation (EU) 2025/486, the competent authority assesses an application within 120 calendar days of receipt. Applications submitted before 15 June 2025 had 180 calendar days.

If the authority asks for additional information, the applicant has up to 30 calendar days to reply, and the whole assessment may not exceed 180 calendar days. Since Implementing Regulation (EU) 2025/2549, consulting other competent authorities or the Commission is optional; where the authority does consult, the consultation must be completed before the assessment period elapses, and consulted parties have no more than 15 calendar days to submit observations.

Frequently asked questions

Can I import while my application is pending?

An importer or indirect customs representative that applied by 31 March 2026 may provisionally continue importing until the competent authority decides. If the status is then refused, the authority establishes the emissions embedded in goods imported since 1 January 2026, using default values, and these are used to calculate penalties.

Can the authorised status be withdrawn?

Yes. It can be revoked if the declarant no longer meets the criteria, or has been involved in serious or repeated infringements of the obligation to surrender certificates or to hold enough certificates in its registry account at the end of each quarter.

What does the authorisation decision contain?

It is registered in the CBAM registry and includes the declarant's name, address and contact details, its EORI number, the CBAM account number assigned to it, and the guarantee required where applicable.
