Article 50 AI Act: labelling chatbots, deep fakes and AI content

Article 50 sets transparency duties for AI systems that talk to people or generate content, and for deployers who publish deep fakes or AI-written text. This page covers who must do what, the exceptions, and the Commission guidelines on implementation.

Duties of providers

Providers must design AI systems intended to interact directly with people so that those people are informed they are interacting with an AI system, unless this is obvious to a reasonably well-informed, observant and circumspect person given the context.

Providers of systems generating synthetic audio, image, video or text, including general-purpose AI systems, must ensure outputs are marked in a machine-readable format and detectable as artificially generated or manipulated. The technical solutions must be effective, interoperable, robust and reliable as far as technically feasible.

The marking duty does not apply where the system performs an assistive function for standard editing or does not substantially alter the input data or its semantics.

Duties of deployers

Deployers of emotion recognition or biometric categorisation systems must inform the people exposed to them. Deployers of systems generating deep fakes, meaning image, audio or video content that resembles existing persons, objects, places or events and would falsely appear authentic, must disclose that the content is artificial.

For evidently artistic, creative, satirical or fictional works, disclosure is limited to an appropriate mention that does not hamper the display or enjoyment of the work. AI-generated text published to inform the public on matters of public interest must also be disclosed, unless it has undergone human review or editorial control and someone holds editorial responsibility.

In all cases, the information must be given in a clear and distinguishable manner at the latest at the first interaction or exposure.

When do the Article 50 obligations apply?

The Service Desk FAQ states that transparency obligations apply and are enforceable from 2 August 2026. Providers of AI systems placed on the market before that date have until 2 December 2026 to comply with the marking and detection obligation of Article 50(2).

Are there exceptions for law enforcement?

Yes. Most Article 50 duties do not apply to systems authorised by law to detect, prevent, investigate or prosecute criminal offences, with safeguards for third parties. The chatbot disclosure duty still applies when such a system is available for the public to report a criminal offence.

What fine applies to a breach of Article 50?

Breaches of the transparency obligations of providers and deployers under Article 50 fall in the tier of up to EUR 15 000 000 or 3 % of total worldwide annual turnover, whichever is higher. For SMEs and start-ups, the lower of the two applies.
